Trustees for the Banning Unified School District recognize that both the board and its individual trustees are bound to comply with a variety of statutory Regulatory and a minute rules and regulations in the performance of our Collective and individual duties can you also recognizes that the individual board members may disregard or ignore duties and responsibilities as a trustee and take actions make statements or otherwise engage in conduct that violates the individual members obligations under statute governing regulations board policy or board Direction the board I cannot and will not tolerate such conduct public as public officials at the elected representatives of our community we must hold ourselves to the highest standards of professional and ethical conduct and set the example for this District and its employees and students that's when Indian any trustee and gauges and improper conduct or unprofessional behavior the board will act to call out that member inform them accountable with the hopes of informing and reforming them so that the offensive conduct is not repeated with that in mind we are here today and on the agenda is resolution 21 2205 which is a resolution to Center trustee anguiano for conduct for purposes of the record I will read the resolution and plant Rd once I finish resuscitation of the resolution and before motion and both areas made member anguiano I have an opportunity to respond resolution number 21 2205 red resolution the Board of Trustees for the Banning Unified School District Centre and trustee Myra Ariana for unacceptable conduct bored while 9005 governance standards states to maximize for defective public confidence in District governance board members are expected to govern responsibly and hold themselves to the highest standards of ethical conduct and whereas board bylaws 9005 for the state board members also to keep confidential matters and whereas the Board of Trustees and superintendent our government scheme requiring the trust and confidentiality of all parties to best support all students and staff without violating such trust and whereas the Board of Trustees for the banner unit School District known as the district has a Judy to the residents of banning and the employees of the district to ensure that the laws of the State of California and the bylaws policies and rules and regulations collectively policies of the district are followed by all members of the Board of Trustees and that members of the Board of Trustees demonstrate the highest level of professionalism and respect while acting in the course and scope of their office and we're as trustee anguiano acted in a manner that is Jayden a pattern of disregard for the laws and policies governing the conduct of members of the Board of Trustees and where I was on December 8th 2021 during a public meeting of the Board of Trustees member anguiano who has been a member of the Board of Trustees since 2019 commence the discussion Open Session regarding the superintendent's evaluation in the message for the conducting and despite no possession regarding the supervisor position in the messenger despite the fact that superintendents about your evaluation was not a matter on the agenda for discussion during the board meeting and where as memory on his conduct during the December 8th meeting violated Brown act District policies the superintendent she writes and was a material breach of the employment agreement with the superintendent and whereas the board had given member anguiano prior notice to refrain from engaging in such conduct stemming from a July 2021 incident where in Denver on Rihanna componential closed session information about the superintendent with a third party who was not authorized to receive stuff in such information and whereas member on Rihanna's violation of state laws in District policies has brought. repeat to the Board of Trustees and the Banning Unified School District undermined employee privacy rights jeopardize the district's position with respect to threatening and pending claims and litigation created a risk of exposure to liability for Bri contract invasion of privacy Brown and violations harassment and desperate treatment as well as other unfair labor practices and whereas the Board of Trustees does not condone or accept the type of conduct and behavior and fines necessary and prudent to declare its strong a vehement disapprove of such conduct and whereas the Board of Trustees is where First Amendment rights but the Man member on Brianna nice limitations and restrictions that said rides based on her dishes are positioned as a public official and whereas the Board of Trustees for the determined said adoption of this resolution is necessary Rihanna's doctors board's regular meeting was a material breach of the provisions of the superintendent's employment agreement that require discussion of a superintendent evaluation to be properly agendas and tell the closed session Section 3 the Board of Trustees find set on December 8th 2021 member on Brianna's public discussion of an on agenda item about a confidential employment matter pertaining to the superintendent and her evaluation comprised to District wine compromise the district compliance with the brown act its own policies and provisions of the superintendent's employment agreement stretching for Board of Trustees find that inner about July 2021 number how Quiana was previously notified of her legal duty to maintain the confidentiality of personnel matters discussed in closed session particularly those pertaining to the superintendent and the procedures for her valuation a in that July 2021 instant member and Brianna was present during a closed session discussion regarding superintendent hurry about equation be subsequent to that closed-session meeting member I'm going on shared private and confidential closed session information about the superintendent with a third party who was not authorized to receive that information see as a result of board member anguiano unauthorized disclosure of confidential closed session animation pretending to the District provided member anguiano with the guidance regarding her duties and obligations under the brown act advice me a hungry young regarding the potential exposure to liability for continued violation assured the superintendent's her privacy interest be upheld by the board notified member on Rihanna her contact exposed to District liability and notified the Riverside County District Attorney's Office of the unauthorized disclosure of confidential closed session information session 5 the Board of Trustees finds that member anguiano engaged in misconduct described above in an effort to undermine the superintendent's privacy interest and circumvent the board's Authority regarding the superintendent's evaluation rather than utilize a pro procedures for agendas in matters which are designed to protect and employees privacy interest in due process rights section 6 the Board of Trustees finds that member on Rihanna's conduct in instances is in addition to being a proper unprofessional and unacceptable was without any authorization or ratification by the Board of Trustees and contrary to the business and administrative interest of the district and that member anguiano acted solely as individual section 7 The Board of Trustees regards member on Rihanna's Behavior as described carrying to be outside the course and scope of her duties and performance as a member of the Board of Trustees Section 8 the Board of Trustees here by don't remember and Rihanna for the conduct described herein and expresses the strongest possible disapproval and disavowal there of in conjunction with Accenture the Border Christian poses the following sanctions a member anguiano hey LeBron Quiana shall be excluded from and shall not participate in the performance evaluation process of the superintendent for the 2021 to 2022 school year which is set forth in the superintendent's Employment contract be in addition to the actions described herein should member on Rihanna attempt to boardwalks and not to any staff member including the superintendent the Board of Trustees declares that member on Rihanna was not authorized by the board to represent take action or speak for or on behalf of the Board of Trustees or the district under any circumstances or with any third-party person agency and a t group or bargaining unit with respect to any matter but with particular regard to the superintendent and her or her where I'm at Jordy of the Board of Trustees has not taken official action or expressly authorized her to speak on the boy's behalf section 10 the board of trustee and demands and expects member on me to cease and desist from any improper and a what kind of shoe is any District employees and in particular the superintendent section 11 members of the board the superintendent and or the district's general counsel are hereby directed to immediately notify the president of the board of Rusty's if number are we on on gauges in future contact that is described by this resolution section 12 it is the intent of the Board of Trustees in the event of future and proper and unprofessional, I member on Brianna to Violet one of the terms of this resolution to personal conduct of the same or similar nature as the violations described in this resolution is she'll be her personal responsibility to pay and pay for any and all legal services in fees incurred their from the district not pay for or provide legal defense or counsel to member on Rihanna because such conduct is outside the scope and course of her duties and responsibilities as a member of the Board of Trustees for the Banning Unified School District not at the end of the resolution prior to the introduction of any motion to censure and prior to any both are on and in an effort to avoid an He had that one as well earlier to Kris B gangs weapons campus Mexico safe from covid and violence and there's another one that's big right here thinking about how is she going to actually take what you want to really put on a show about that enhance relations with units open communication for staffs to remove to be able to share concerns or anyting better communication so that's another one that's broad so think about how if that's yours and you or you like the idea that a communication again improve educational programs for a student scores and grades and test scores and grades might be how you know but think again about improving educational programs how is that a priori how would you know at the board that the scaffold fine tuning programs with academic and Behavioral anybody remember fine-tuning suggest is that continued emphasis on specific programs remember okay okay okay so heard that cuz what I'm here and then is applying programs appropriately and making sure that the right tools are being used in the right stuff that's coming on the way saying that okay so can you example okay okay so one of the things I'm going to ask you is important to think about is having a having a priority that's even though I said it specific is still at 30,000 ft level so so not how would you come up with right vocabulary that's pretty in the weeds right that is that works in those different programs but maybe it's about better focusing on understanding how these programs are being so you've used to work the Della TSO delivery of specific programs with Fidelity and developing the Banning interpretation as needed right cuz we don't overlap and that we're not contradictory and confusing but again for the Ford it's not doing that work that had a weave how would I know as a board member that that's being done in the appropriately appropriate for students and staff to be in but I'm assuming appropriate just means the facilities are in good repair and are satisfactory in terms of furniture and we don't have the PE people in the lunch room or in a you know in our class so I'm not sure appropriated is it more about the standard of the facilities facilities appropriate for students and staff to the end is that there an acceptable condition I feel like sometimes there are things where I wouldn't have allowed that in my house for my child to be around with the why are we doing that with carpet RPG it does not look right insurance tax safety at Allstate Kristina uptain more programs for graduation as much as the need so really motivating our students attracting and growing our district to make it appealing to students as much as staff and similarity they're hiring more qualified staff security sodium Safety and Security he put a few times education in parentheses respect stronger Sports programs and regular High School bridge program budget bootcamp LOL oh okay we see did you want to spend on boot camp just like programs for Board of Education like extracurricular activities for things that can get our kids how can I put this delicately okay extracurriculars. I have another one for safety but I think we see at least one thing working and learning environment I can read minds, so that's a good thing Communications another one here and included in that rental Community engagement improving educational and then safety and then open communication removing fear of retaliation princess Community engagement and Franklin in the program. so quite clearly communication is something you all straight out of the gate they want to work on that right you also all 5-day want to focus on safety so can we agree that we're going to refine those priorities that that's a Doctor Baker want you to really feel safety they can interpret that a variety of way what are you asking you in Maine the board understands the priority was there and hear the activities with secure and you you interpret of safety as covid-19 protocol you're not going to get the right data all right what about this one and come up with something specific and targeted so six months we know that grad race are of focus ground stop it I don't know if you saw their results recently about last year last year across the state again some of these are the whole platoon but we're trying to practice here's what you're going practice starting in June with the next several years is sending those few priorities that of course and we want you all to have a Waze like focus on these three to four six wood graduation be one of them well I can kids make up between now and the end of the year and kids be targeted I can't offer to ensure that their on trap maybe I think also technology even though I know it's that one wants the one with the technology but there are classes that haven't been able to utilize their computers because there's no charging station so I know that's affecting our academic achievement okay so the net kind of goes back to your a key piece so between now and then in the end of the year are you already if it was it you know something you know and and classroom utilization of ID that's something that's it at the tangible measurable piece is that again what you think they're doing all the work. Working all day every day but things are so important and want to make sure we're hearing about it the board meeting and look at it as we reassess our next priority acting like graduation is there ever be a good comedian open Audible credit or if you ready for graduation current legislation Casper kids to still graduate with 130 so that's going to help also for those kids who are further behind but so there are no number of strategies that are utilized by councillors just yesterday we had a date of meeting or we looked at 36th student individually and terms of their credit efficiency and from there the actual decision is made on which kids need to take taking the classes to get out in June and or all by August by the end of summer and so what that program needs to look like and so at the district level we work primarily with the district office and the school leaders in the school leaders are taking responsibility of providing directions to Port to the counselors which is what you hear. The lion saying about counselors really doing the work around what classes are needed but we currently have 36 seniors who are trying to get out on time which is Nipigon increase if we can get them all to graduate by August as you're told me your account number we don't have the resources get focused that way right budget cooking TV really single and that's about going to the soda and the cannibal why do indeed remember these priorities I don't want to do is have a miserable so I'm not covering its terrible but will be published Orinda actually helps the school the instructional leaders become instructional leaders by working with standards prioritizing which standard teachers are going to teach in understanding the day and being able to use that information how to really Target with students need of you just won't hear I'm talking to a teacher so I feel a little weird saying that cuz you already know this stuff but five teachers are teaching English and they're all teaching different standard without understanding which kids need for standards to close achievement Gap then you really don't accelerate soon achievement right because it's not targeted and I think that more of us are understanding that some of our soup School what I'm hearing is that a long with orenda so for example you know this week we're going to be doing this coming week we're going to be doing are like third or fourth instructional walk where all the principals all of us instructional leaders are going into particular classrooms peaches are ready they're teaching Pacific Standard and then after that there's a dialogue around what practices we saw and not supposed to increase and it does increase instructional capacity of the actual principles right so that they can intern long-term support instruction as an instructional leader so what I'm hearing them for the gold academic goal for this year would be in your classroom in other classrooms in building the capacity of the principles to do that work right so that they can be on campus and on-site supporting teachers instruction so what so are we still working on graduation but also best practices in the classrooms on our side throughout the school district best practices for crazy best practices right now but we're doing all School sites this year as a board member Martinez Larry ring in are you at that graduation rates is something you'd like a priority.
